Looking for Home Tour Homes!

We still do not have enough houses confirmed to be on the tour! If you have a home, you could help! Yes, it is a lot to ask of you, but homes are the one thing we can’t do without for our home tour. Your house does not have to be perfect. If there are some renovations half-finished or yet to be started, our guests will enjoy learning about what we go through to get these houses in shape. Home Tour Countdown by Evelyn Montgomery

Fall will be here before you know it-and so will our fall home tour. It is time to get down to the business of marketing our tour so we have lots of visitors and sponsors. Remember, the profits go to improving Buckner Park, a project that will help the whole neighborhood, so we all want the home tour to be successful. There are many volunteer slots to be filled, large and small. We have a place for you, whatever time and talents you have to offer. We are looking for:

  • Home tour committee members. Help plan the event and lend a hand with the many details along the way.
  • Marketing/sales people who can go out and get sponsorship money and in-kind donations from local businesses.
  • I know we have some great salespeople in our neighborhood.
  • House Captains, one for each house. Sometimes the owner of the show house is the captain, sometimes they want someone else to help. House captains plan the route people will follow through the house, placement of docents and what they will say. Captains line up docent volunteers and help the homeowner get ready.
  • Silent Auction, a big money maker in the past. We need a committee member to coordinate getting the donated auction items and to arrange the sale.
  • Event workers. Docents for the houses, help to set up the party and clean up afterwords, take tickets, auction
    volunteers, put up signs.
  • Kids can help as well. We need adorable tykes to
    staff lemonade stands. Do you know a cute kid?

Home Tour Countdown - Nine Short Months by Evelyn Montgomery

The date for our next home tour, our first fall home tour, in October 24. That is the weekend before Halloween and after the close of the state fair. Hopefully, our fall tour will lure visitors with seasonal plantings and decorations, as well as our neighborhood’s great architecture. A successful home tour is an opportunity to make some money, get publicity for our neighborhood and our home owners association, and attract visitors who might be so impressed that they become our new neighbors.
As your humble home tour chairperson, I need to start gathering two things-people and houses. I will need to assemble a home tour committee, hopefully not limited to the members of the board. I also want a co-chair, because I am lazy. The co-chair would ideally by friendly and popular, to assist with pursuing volunteers, as I am known for my shyness and hermit-like habits.
The houses I seek are those which will thrill and amuse the visitors. I would like six locations. Your house does not have to big or elegant to qualify-though it would nice to have at least one like that. Funky decorating, interesting collections, walls stripped to the shiplap, these are just a few of the features that might make your house perfect. Lest you think I am asking you to do something I would not do myself, my house is already signed up for the following tour, fall 2012!

Efforts Underway to Make Neighborhood Street Safer

PAHA is currently collecting signatures for a petition to implement a four way stop at the corner of Swiss Avenue and Grigsby Street. Residents who reside within 900 feet of this intersection and are interested in making it safer should consider signing this petition. Swiss Avenue Historic District Soiree to Benefit Neighborhood Park and Playground

Four Swiss Avenue homes will offer cuisine, cocktails, music and entertainment from around the world at “A Taste of Swiss” on Saturday, October 10. Italy, Brazil, India and Turkey will be represented at this fundraiser benefitting the Friends of Buckner Park. With passports in hand and the leadership of a tour guide, guests will tour each home experiencing the flavors, music and entertainment representative of each country’s culture. Tickets for this event are $100 per person and are available for purchase online at www.friendsofbucknerpark.org or in person at Needless Necessities (2926 N. Henderson Ave.) and Talulah Belle (2017 Abrams Rd.). Check-in will be from 6:30 to 7:00 pm at 5001 Swiss Avenue.
“A Taste of Swiss” is organized by residents of the four East Dallas historic districts (Swiss Avenue, Peak’s Suburban Addition, Munger Place and Junius Heights) and the Friends of Buckner Park as a fundraiser benefiting the restoration of Buckner Park. This neighborhood park, located at the corner of Worth Street and Carroll Avenue in Old East Dallas, also serves as the Ignacio Zaragoza Elementary School playground. Buckner Park is situated at an important gateway intersection linking Old East Dallas with Lakewood, Downtown, Fair Park and Deep Ellum. Unlike the timeless homes restored in the area, the park has deteriorated over time and has suffered from vandalism and neglect. The Friends of Buckner Park was formed to restore the park and make it a beautiful retreat for the entire community to enjoy.
“So far the community has been overwhelmingly supportive of the endeavors of the Friends of Buckner Park,” Andrea Nicolas, Friends of Buckner Park president, said. “Our vision for the park includes a walking trail, new playground equipment, a pavilion and a venue for annual fundraising events that will benefit the park and its restoration.”

“A Taste of Swiss is a unique opportunity for our guests to spend an intimate evening, with an international flair, in four beautifully restored early 20th Century Swiss Avenue homes,” Larry Waisanen, co-chairman of the event, said. “In addition to raising funds for the park, we want this event to help to create an awareness in the broader community of the tremendous opportunity that the restoration of this historic City Park offers to East Dallas and the surrounding area.”
Formed in 2006, the Friends of Buckner Park is a 501(c)3 nonprofit organization created to revitalize Buckner Park in partnership with Dallas Parks and Recreation Department and make it a clean, safe, urban green space for the community.

Invitation to "A Taste of Swiss" Event

On October 10, 2009 experience an evening of international tastings in the Swiss Avenue Historic District. At “A Taste of Swiss”, organized by volunteers from the Swiss Avenue, Peak’s Suburban Addition, Munger Place and Junius Heights Historic Districts, four historic Swiss Avenue homes will be “on tour”, each representing an international destination—Brazil, Italy, India and Turkey. Guests will receive a passport and travel with a guide to each of these homes where they will sample hors d’oeuvres and signature drinks from each country while enjoying music and entertainment representative of the country’s culture. Check in will be from 6:30 to 7:00 pm on Saturday, October 10 at 5001 Swiss Avenue. Following a champagne bon voyage toast, our travelers will begin their international culinary experience. “Touchdown” back in Dallas will be at 11:00 pm, where guests will be “welcomed home” with an arrival sweet. Tickets for this tour are $100 per person and can be purchased online at www.friendsofbucknerpark.org or in person beginning September 1 at Needless Necessities (2926 N. 2010 Bond Package

Be sure to give your input to PAHA's submission of requested priorities for the 2010 bond package. Here's what has been gathered thus far:

  • Swiss Avenue paving/curbs/gutters between Carrol and Fitzhugh

  • Electric/utility line burial
  • Curbs/sidewalks on Peak between Gaston and Worth

MZ Grocery Victory!

On March 26, 2009, MZ Grocery’s appeal of TABC’s decision not to renew their alcohol sales permits was held in the 44th District Court before Judge Carlos Cortez. Following a 90-minute hearing, Judge Cortez affirmed TABC’s decision denying renewal of the permits. This confirms the administrative law judge’s previous ruling and represents a huge victory for the neighborhood.

TABC’s order takes effect immediately, though the agency may give MZ Grocery a little time to dispose of its inventory. Nonetheless, alcohol sales should cease within a few days.

Many thanks to the sizeable group of neighbors who showed up (many for the fourth time) at the hearing to voice their support in the form of their attendance. Once again, the showing of community support on this issue was invaluable. Also, much appreciation is due to Nick Canaday from the Texas Attorney General’s Office, who was tasked with arguing for the affirmation of TABC’s order with only 6 days to learn all the facts and prepare the legal arguments.

ACTION REQUIRED: MZ Grocery Hearing Thursday, March 26

Alright everyone, it's time to rally the troops for MZ Grocery one more time. They have filed their appeal and the matter is set for hearing next Thursday, March 26th at 9:30 a.m. It is being heard in the 44th District Court (Judge Carlos Cortez), which is located downtown in the George Allen Courts Building at 600 Commerce Street (this is different from where the trial was). This is very short notice, but that is the timeframe that the procedural rules dictate.

We need as many people there as possible. No one will have to speak and, in fact, the Protestants sole mouthpiece will be the Attorney General's Office (who represents TABC, the technical "Defendant"). However, just as with the original trial, neighborhood participation through attendence will be very important.

Date: Thursday, March 26
Time: arrive in court by 9:15
Location: George Allen Courts Building, 600 Commerce Street
Parking: there are various parking lots around the courthouse, but there is underground parking connected to the courthouse (entrance on Commerce St. by the Old Red Courthouse) that is very convenient. Approximately $8-$9.
Duration: The hearing could last anywhere from 10 minutes to 2 hours, but it should not be an all-day event like the trial.

This is the final step, if we are successful, at having alcohol sales discontinued at MZ Grocery. A final ruling is due by March 30th, so the end is potentially in sight. We need everyone's help to try and finish this out!

Tree Planting Project Update by Zelman Brounoff

Our Crepe Myrtle/parkway planting initiative got unanimous approval at the February 12, 2009 task force meeting.
All should go well with the approval process from The Landmark Commission, so look for the planting of nearly 30 trees to take place in March along Junius, Worth and Sycamore streets.  
There will be an assortment of red, pink, purple and white varieties planted.  If your parkway has been selected to receive free trees, please do your part by keeping them watered this summer.  
Thank you to those neighbors who agreed to be a part of this project.  Also thanks to Elizabeth Nelson, who volunteered her time with the planting initiative.

Did you know there are tax incentives available to historic properties?

In Peak’s Suburban Addition, property owners doing or planning on doing rehabilitation work on their properties are eligible to receive an exemption from the city portion of their property taxes for 10-years!

For example, if you have a house worth $100,000 if you spend $25,000 on rehabilitation of the house, the city can zero the city portion of your property taxes, which amounts to savings of about 1/3 of your tax bill!

Qualified expenditures include labor and materials for interior or exterior repair or replacement of features that help preserve a structure, such as, but not limited to, roofing, windows, sheetrocking, carpentry, electrical, plumbing, mechanical, flooring, and replacing fixtures such as sinks, bath tubs and toilets.

Just doing a little work? There’s an exemption for you too.

City holds free Foreclosure Prevention Workshop

Lenders will be on hand to answer foreclosure questions

WHAT: The City of Dallas, the North Texas Housing Coalition (NTHC) and Fannie Mae are working together to assist persons having trouble paying their home mortgage by hosting a free Foreclosure Prevention Workshop.

Attendees will have an opportunity to speak with a HUD certified counselor, mortgage service provider and learn about home retention programs. Lenders are ready to work with borrowers to address their current mortgage situation.
 
Persons attending the workshop should bring the following information if possible:

  • Latest mortgage statement
  • Two most recent months of pay stubs (tax returns and W-2 forms if self-employed)
  • Hardship letter explaining reason for home loan default
  • One-month most recent bank statement
  • Budget breakdown explaining monthly expenses

A few updates from the January Meeting

A few brief updates and reminders from tonight's meeting:

  • Membership dues are due! In order to continue operating and making great things happen, we need your support. For instructions on submitting dues, click here.
  • Officer Kelly Qualls announced the crime in Dallas is down 10%. In the Central Division, where PAHA is located, crime is down 21%! Show your commitment to continued progress in fighting crime at the January 15 Crime Synopsis Meeting.
  • At the request of a neighbor, Officer Qualls is researching whether the secondary emergency route designation on Swiss Avenue can be removed to allow for pursuit of speed bumps.
  • The Tree Planting project approved at the December meeting is underway. Tree planting sites are being planned and property owners will be contacted. Neighbors whose property is not selected as a site may purchase trees through Texas Trees Foundation as part of this effort. Contact Zelman Brounoff with questions.
  • Some neighbors were surprised to learn you can call 311 to report potholes!
  • Planning is underway for the 2010 Bond Election. PAHA will develop a list of priorities based on neighbor input. If you see problems around your street or around the neighborhood, submit input for the bond package at the February General Meeting or to PAHA's President or 2nd VP.

Central Patrol Division's Year End Crime Synopsis

You and your guests are invited to the Central Patrol Division’s Year End Crime Synopsis on Thursday, January 15th, beginning at 6:30pm, at the César Chávez Learning Center, 1710 N. Carroll Street.

The meeting’s focus is to inform residents of crime trends seen during the past year, of current crime trends, of successes in combating crime, and to encourage continued dialogue between the public and the police Department. The new Central Division Watch Commanders (Lieutenants in command of each watch, or “shift”, and responsible for different geographic areas within the Central Division) who have come to the Central Patrol Division will be introduced at the January meeting.

Past meetings have proven very successful. Information exchange, both from police to the public, and from the public to the police, has helped to identify areas and trends that needed to be addressed.

This meeting is open to the public.

ACTION NEEDED: Form Based Zoning Case Dec. 10

FORM BASED ZONING DECISIONS – DECEMBER 10th – EMAIL OR CALL COUNCIL TODAY!!

THREE KEY ISSUES are still needed to protect our neighborhoods and to make the form-based zoning ordinance an effective tool. There are three items that still remain “off of the Natinsky / Staff Form Based Zoning Ordinance” and Dallas needs these items included. Neighborhoods and Developers are on the same page with this plea. 

WE STILL MUST ASK THE COUNCIL TO:

  • INCLUDE Critical Mass,
  • INCLUDE Residential Transition Neighborhoods,
  • INCLUDE Residential Proximity Slope.

If you do not understand what these items mean, some examples applicable to Peak’s Addition are listed at the bottom of this article.

If these items are not in the ordinance, each of these issues would have to be fought on a case-by-case basis going forward for generations. This will be a waste of time for us all. If we include these 3 items in the ordinance, we can spend our volunteer hours working for parks and schools, as opposed to fighting zoning cases. 

Please give the City Council your personal perspective as someone who ends up working on neighborhood zoning issues or as someone who lives next to a structure that is inappropriate. All three items we need are included as "green" options in the City Council 's copy of the ordinance.

We want the Dallas City Council to “VOTE GREEN” on Wednesday. 
When you email the Council, ask them to vote for the GREEN AMENDMENTS included in their packets. 
These are the Developer/Neighborhood Compromise. We are not asking for everything that we need, but feel that these are the top three items that MUST be included.

CORRECTION: Form Based Zoning City Council Hearing 12/3 9 a.m.

The City Council Public Hearing will be next Wednesday morning, December 3 starting at 9 am in room 6ES at City Hall. The Developer-Neighborhood compromise is supported by Preservation Dallas, the Dallas Homeowners League, the Old Oak Cliff Conservation League, the Real Estate Council, and the City Plan Commission. City staff will be presenting a different version that does not include several key elements that will protect stable, single family neighborhoods.

City Council may vote on this at the public hearing. Please consider attending to show your support for the Developer-Neighborhood compromise version.

MZ Grocery

On October 21, 2008, Judge Jerry Van Hamme issued his ruling in the MZ Grocery protest. I am pleased to announce that he ruled for the Protestants and in favor of denying MZ Grocery’s requested renewal of its alcohol sales permits. Ultimately, he found that we proved that the manner in which MZ Grocery’s business has been conducted warranted a refusal of their permit and license based on the general welfare, health, peace, morals, and safety of the people and on the public sense of decency.

Many neighbors took time to come to the multiple trial settings and sat around all day while the final trial was conducted. This support was greatly appreciated and did not go unnoticed. Also, another very special “thank you” to City Councilmember Pauline Medrano who took time to write two letters of support and appeared at trial to testify live.

On August 22, 2008, the State Office of Administrative Hearings held the long awaited hearing on the protest of MZ Grocery's alcohol sales licenses.  The neighborhood put on its evidence of why the permits should be denied, and the Dallas City Attorney's Office presented its best case as well.  The judge took the arguments and evidence of all parties under advisement and should issue his ruling within the next month.

Many thanks to the large group of neighbors that showed up that morning to lend their support in the form of their appearance.  Also, many thanks to all the neighbors that showed up for the previous two settings.  The neighborhood owes a large debt of graditude to Elizabeth Nelson for initiating this protest and seeing it through for 2 1/2 years, to Adam McGough of the Dallas City Attorney's Office for continued support of the neighborhood's efforts, and to our City Council Representative Pauline Medrano who made an appearance at the hearing to voice her support of the protest.

Dallas Dirt Skirt Hearing Results by Elizabeth Nelson

Neighbors from all over the City of Dallas showed up to the Board of Adjustment hearing this month in support of the applicant's request that the Building Official's 'green tag' for the Building Permit for 6159 Oram Street be reversed / overturned.
Our neighborhood board voted unanimously that we support the applicant and believe this Building Permit and 'green tag' should never have been granted. The building official incorrectly interpreted grade and therefore height.
We believe the Building Official erred in his interpretation of 'grade.' Grade should not be artificially raised 8, 10, or 12 feet or more into the air. This has been accomplished at 6159 Oram by what has variously been called:

  • a 'dirt skirt'
  • 'dirt stilts' built at each corner of the building
  • 'dirt wallpaper' since dirt was applied to the outside of the building after it was built
  • 'dirt buttresses' that are actually a part of the building and do not meet setback requirements

ACTION REQUESTED: Dirt Skirt Hearing

This zoning hearing affects all of our neighborhoods and we need many e-mails and people present. No one wants to live next door to, or back up to, a structure that is now a full one-story higher than is allowed by our zoning codes.

Wherever your neighborhood borders on multi-family, commercial or planned development district zoning, it will be DIRECTLY affected by the outcome of a Board of Adjustment hearing this Tuesday, August 12th at 1:00 p.m. in the Council Chamber. PLEASE MAKE EVERY EFFORT TO ATTEND.

Please send emails and letters asking the Board of Adjustment to:

  • rule IN FAVOR of the applicant and to find that the building official erred in his determination that this was a three-story (36 foot) building.
  • rule that the "grade level" from which the height of this building should be measured is the grade of the actual ground the building sits upon.

We believe the building official ERRED when he decided to measure the height of the building from an artificial "grade level" consisting of the top of a dirt berm or dirt buttress, mounded up against the corners of the building, rather than from the ground level ("grade level") on which the entire structure all sits.

MZ Grocery Final Hearing Scheduled by Walker Duke

The final hearing on the protest of MZ Grocery Store's alcoholic beverage permit has been scheduled for Friday, August 22, 2008 at 10:30 a.m. It will be held at the State Office of Administrative Hearings, located at 6333 Forest Park Road, Suite 150-A, Dallas, Texas 75235. After several postponements, our protest will finally be presented to the Administrative Law Judge for a final ruling.
We have had a great neighbor showing at the previous two settings. This sent a clear message to the administrative law judge that the neighborhood has united in this cause. PAHA is calling on your support one more time. We need as many neighborhood residents as possible (PAHA members or otherwise) to be in attendance at the August 22nd hearing to demonstrate to the Court just how unified the community is on this issue. If you have first hand knowledge of shady activities at or around MZ Grocery, or have documentary evidence of this (e.g. pictures, video, etc.), please contact Walker Duke at 214.891.8034, as you may have an opportunity to share your experiences with the Court. Even if you do not wish to testify at the hearing, everyone's support in the form of their attendance will be vital. If you cannot make it to the hearing but would still like to contribute to the cause, we would welcome letters to the Court. Gaston Avenue and other Area Development by Elizabeth Nelson

So the real estate market is slowing down? Well, it doesn’t seem like it in East Dallas. Several developments are taking place in and around Peak’s Addition. So many, it’s difficult to keep up! For starters, we all know about the “Office Depot” shopping center at the corner of Gaston and Haskell. Office Depot, Lenny’s Subs, State Farm Insurance, Divino’s, and T-Mobile are all officially open for business, so please visit soon! On the corner of the site, a bank is being constructed right now. This will be a Capitol One Bank. Across the street from the Office Max Center, between the 7-11 and Church’s Chicken, the old Divino’s will be torn down, as well as the coin laundry. In their place will be an Aldi grocery store. This will be a great little neighborhood grocery with all of the basics, within walking distance for some. Friends of Buckner Park by Elizabeth Nelson

Peak’s Addition and Munger Place neighborhoods have teamed up to form a 501c3 non-profit in support of the revitalization of Buckner Park. Appropriately named Friends of Buckner Park, the non-profit will work in conjunction with the City of Dallas to raise funding (private, public, and corporate) for the implementation of the existing Master Plan for the park. Initial paperwork and bylaws has been established and the official application to the IRS is to be submitted shortly.
Volunteer Board Members and Committee Chairs include: Elizabeth Nelson, JW Brasher, Andrea Nicolas, Jim Anderson, Brandon Castille, Sharon Van Buskirk, Janet Staring, and Sandy Doss.
The group will work collaboratively on design details for elements within the park, grant applications, fundraisers, marketing, requests for bond program funding, and other activities related to the design and implementation of the park’s Master Plan.
Generally, the time frame for the IRS to approve a 501c3 application is about 90 days. Meanwhile, the group will be working on fundraisers and efforts that do not necessarily require 501c3 status.
Both Peak’s Addition and Munger Place find this park a very important and necessary improvement for both neighborhoods and look forward to working together with the city to make the plan a reality.

Buckner Park Update by Elizabeth Nelson

After the neighborhood and City of Dallas has put forth years of planning, redesign, gathering feedback, negotiating, and more designing, the City of Dallas Parks’ Department has finalized a Master Plan for Buckner Park. Now that the plan has been finalized, the next steps are: Park Board adoption, DISD land acquisition, fundraising, bond program allocation, and implementation.

2008 Clean Up Dallas Event - Trash Attack & Graffiti Wipeout

What is it?
The 2008 Trash Attack and Graffiti Wipeout is a City-wide community effort to remove litter and trash and abate graffiti in our City.

Who can participate?
Anybody can! This is a great event for families, Scout troops, schools, and private corporations. You can even earn community service hours for school for this! *Minors will need adult supervision and have a signed liability waiver from their parent or guardian for the day of the event.

Where do I register and check in?
Registration will open online April 1. You Check-in Locations are listed below for the area you choose.

Dallas Police Department Quarterly Crime Synopsis

Dallas Police Department's Central Patrol Division will be hosting its "Quarterly Crime Synopsis". The meeting will address crime concerns and how Central Patrol plans to elevate them. There will be opportunities to share information about our neighborhood with our Geographic Area Commanders. Please mark your calendar for this event. Mature Trees Torn Down at Live Oak & Grigsby - Submitted by Nicole Carnot

Remember all the big beautiful trees that used to be on the corner of Live Oak and Grigsby? It seems that Peak Academy's construction plan has been to do what they want, when they want, regardless of what the city has mandated (besides bulldozing those trees, they also have been working hours outside of what city code permits). If we all write letters expressing our outrage and disappointment about the ruining of the green space and illegal removal of trees, the Zoning Commission is more likely to be stringent with Peak's architects and insist that they work to appease the local homeowners (i.e. more greenery/trees).

There is a hearing scheduled for April 10 for the latest construction plan for the parking lot to be approved by the city. The Chief Arborist says that the plan that is currently submitted DOES NOT have any islands within the parking lot for trees, only shrubs and intermittent trees around the border. He is looking at the long run (30-50 years) from now, and is asking that the plan be modified to include a few islands within the parking lot for trees.

PLEASE write a letter to the city. If there are a pile of letters in the folder when the plan goes up for review, the city will take the damage that has been done more seriously, and they will see that the neighborhood stands together for improvement.

Update on Home Tour 2008 Benefitting Buckner Park by Janet Staring

Peak’s Addition will host a Historic Home Tour and Celebration Picnic on Sunday, April 20th to benefit the restoration of historic Buckner Park. The Celebration Picnic will be held at Buckner Park from 1:00-6:00 p.m. and will feature local dignitaries, a presentation of the Bucker Park Master Plan, great local bands, food, drinks, and a photographic and memorabilia display of Old East Dallas history. Tickets for the Home Tour, which will be open from 2:00-5:00 p.m., will be available at the picnic or any of the homes on the tour for $10 each. Tickets can also be purchased in advance at hometour.peaksaddition.org.
In order for the Home Tour to be a success, we need your participation! We have several volunteer opportunities available so please help us make this year’s Historic Home Tour the best yet. Volunteer opportunities available include:

  • distributing flyers, marketing, and getting the word out
  • planning and execution of the picnic, including setup and breakdown the day of the event
  • selling tickets, docenting of tour homes

PAHA Opposes Reconciliation Outreach SUP Proposal at Peak & Bryan

The City Planning Commission review of Reconciliation Outreach's request for a Special Use Permit to turn the Brannon Building at the corner of Peak and Bryan Streets into an elementary charter school has been delayed. Our Homeowners' Association opposes this request, and will provide more information for the date of this review when it is available, so that members can attend the meeting to voice their opposition.

Buckner Park Update -- by Elizabeth Nelson

Forward momentum continues with the design and implementation of the new and improved Buckner Park master plan. Several volunteers stepped forward to provide input and design expertise for the master plan design. This neighborhood task force, consisting of residents primarily from Peak’s Addition, will begin a series of meetings with the Parks Department landscape architect within the next few weeks.
